| dc.description.abstract | يتناول هذا البحث قضية من قضايا الفقه الإسلامي والقانون الجزائري ألا وهي الوصية حيث يعالج موضوع الوصية من حيث ماهيتها ومشروعيتها و أهم خصائصها وأوجه الشبة بينها وبين ما يشبهها وأركانها شروط كل من الصيغة والموصي والموصى له والموصى به كما يتناول إثباتها وشهرها, مبطلاتها وحالة التزاحم وحالة التنازع, كما يتناول التنزيل في القانون الجزائري, وشروط من يجب لهم التنزيل ومقدار التنزيل. الكلمات المفتاحية:الوصية ، الفقه الإسلامي ،القانون الجزائري Abstract: This research deals with one of the issues of Islamic jurisprudence and Algerian law, which is the will, where it deals with the issue of the will in terms of its nature, its legitimacy, its most important characteristics and the similarities between it and what is similar to it and its pillars.
