| dc.description.abstract | تهدف هذه الدراسة لتسليط الضوء حول موضوع الحماية الجزائية المقررة للطفل من الاعتداء الواقع عليه جراء تعامله بالوسائل التكنولوجية الحديثة من كومبيوتر أو شبكة معلوماتية، وذلك من خلال تقصي واستقراء مدى توفير وتحقيق المشرع الجزائري لحماية جزائية للطفل من الجريمة الالكترونية الماسة بشخصه، خاصة في ظل التصاعدات الخطيرة كمًا ونوعًا التي أصبح يشكلها الفضاء الرقمي بفعله على الأطفال الذين أصبحوا عرضة للاعتداء عبر هذه الوسائل بأفعال توصف بأنها غير ملائمة أخلاقيًا من تحرش وإغواء واستغلال جنسي أو حتى سرقة البيانات الشخصية له، كل ذلك في ظل انعدام قانون خاص ينظم الجريمة الإلكترونية في التشريع الجزائري إلا ما هو منصوص عليه في شكل مواد ضمن قانون العقوبات وقانون مكافحة تكنولوجيا الإعلام والاتصال وهذا بتحليل نقطتان أساسيتان: ـ الواقع الحمائي للطفل من الجريمة الإلكترونية وأنواعها؛ ومحاولة استقراء الأنواع التي يمكن أن تمس الطفل في العالم الافتراضي على غرار الواقع المعيش. ـ الآليات والسبل الكفيلة لمحاربة هذه الجريمة الواقعة عليهم وضمان حمايتهم، من خلال إبراز الجهود الدولية والوطنية في التصدي للجرائم الالكترونية الواقعة على الطفل، خاصة أمنيًا وتقنيًا ثم قضائيًا. الكلمات المفتاحية: الحماية الجزائية، الجرائم الإلكترونية، الطفل، الاستغلال الجنسي، القاصر، الحدث، الجانح. Abstract: This study aims to shed light on the subject of the penal protection established for the child from the abuse that occurs to him as a result of his dealing with modern technological means of a computer or an information network, through the investigation and extrapolation of the extent to which the Algerian legislature provides and achieves a criminal protection for the child from electronic crime affecting his person, especially in light of the dangerous escalations The quantity and quality that the digital space has become by its action on children who have become vulnerable to abuse through these means by acts described as morally inappropriate, such as harassment, seduction, sexual exploitation, or even theft of his personal data, all of this in the absence of a special law regulating electronic crime in Algerian legislation Except what is stipulated in the form of articles within the Penal Code and the Law on Combating Media and Communication Technology, and this is by studying and analyzing two basic points: The child's protective reality from cybercrime and its types; And the attempt to extrapolate the types that can affect the child in the virtual world, similar to the living reality.The mechanisms and means to combat this crime against them and ensure their protection, by highlighting international and national efforts to address electronic crimes against children, especially security.
