Abstract
في ظل التطور التكنولوجي الذي يشهده العالم، أضحت التجارة الالكترونية واقعا معترفا به وذلك بالنظر لما لها من مزايا تساعد على توفير الوقت والجهد والمال، غير أن الطبيعة العالمية لشبكة الانترنت، واستحالة الاتصال المباشر بين البائع والمشتري، لا يدعنا نستبعد المخاطر التي يمكن أن تحدث والتي تفرض ضرورة حماية المشتري أو المستهلك باعتباره الطرف الضعيف في عقد البيع الالكتروني خاصة في مرحلة تنفيذه، وتتجسد هاته الحماية في عدة ضمانات مستحدثة تتمثل في الالتزام بالإعلام والحق في العدول.
