ملخص
لقد صنف الدستور، السلطة العليا، ضمن المؤسسات الرقابية وزودها بصلاحيات واسعة، تتولى بموجبها وضع استراتيجية وطنية للشفافية والوقاية من الفساد ومكافحته، والسهر على تنفيذها ومتابعتها، والمساهمة في أخلقة الحياة العامة وتعزيز مبادئ الشفافية والحكم الراشد، والمساهمة في تدعيم قدرات المجتمع المدني والفاعلين الآخرين في نشر ثقافة نبذ الفساد وحماية المال العام. وفي إطار تكييف المنظومة القانونية مع الدستور، تم اصدار القانون رقم 22-08 بتاريخ 5 ماي 2022 الذي يحدد تنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته وتشكيلها وصلحياتها، والذي منح بدوره للسلطة العليا صلحيات قانونية أخرى لا تقل أهمية عن الصلاحيات الدستورية، لعل أهمها "التحري الإداري والمالي في مظاهر االثراء غير المشروع لدى الموظفين العموميين". وقد حرص ذات القانون على توسيع تشكيلة مجلس السلطة العليا، لتشمل إلى جانب قضاة وشخصيات وطنية ممثلين عن المجتمع المدني، ايمانا تاما بالدور الذي يمكن أن يلعبه المجتمع المدني كشريك أساسي ورئيسي في مكافحة الفساد والوقاية منه والتبليغ عنه.
The constitution classified the supreme authority among the oversightinstitutions ،And he provided it with wide powers according to which it undertakes to develop a national strategy for transparency and to prevent and combat corruption, to ensure its implementation and follow-up, to contribute to the ethics of public life and to promote the principles of transparency and good governance, and to contribute to strengthening the capabilities of civil society and other actors in spreading the culture of rejecting corruption and protecting public money.
In the framework of adapting the legal system to the constitution, Law No. 22-08 was issued on May 5, 2022, which defines the organization of the supreme authority for transparency, prevention and combating corruption, its formation and powers, which in turn granted the supreme authority other legal powers that are no less important than the constitutional powers, perhaps the most important of which is " Administrative and financial investigation into the manifestations of illegitimate wealth among public officials.
The same law was keen to expand the composition of the Council of the Supreme Authority, to include, in addition to judges and national
personalities, representatives of civil society, in full belief in the role that civil society can play as a basic and main partner in combating corruption, preventing it and reporting it.
