dc.description.abstractThis study addresses the crime of abortion as one of the serious offenses that pose real risks to a woman’s life, particularly when performed outside official healthcare frameworks and without medical oversight. The Algerian legislator has established special criminal protection for the fetus by criminalizing abortion and imposing penalties ranging from misdemeanor to felony, depending on the circumstances of the act. The act is classified as a felony when accompanied by aggravating circumstances, such as the death of the pregnant woman, for example. It is noteworthy that legal rules, although general and abstract, are not without exceptions, as the legislator has excluded certain cases from criminalization, most notably cases of extreme necessity aimed at saving the mother’s life .
