| dc.description.abstract | يعتبر الطفل هو أكبر ضحية متضررة من انفصال والديه، حيث يصبح عرضة للضرر المعنوي والمادي، هذا الأخير يتمثل في حقه في النفقة بجمع مشتملاتها والتي باتت أكثر القضايا المطروحة لدى المحاكم، مما استدعى بالمشرع الجزائري إلى الإسراع في الحد من تفاقم مشكلة تقاضي نفقة المحضون، وذلك باستخدام صندوق خاص بها بهدف: - المحافظة على الاستقرار الأسري. - رفع الحرج على المطلقة وطفلها المحضون في حالة عجز الزوج (الوالد) على دفع النفقة. - صندوق النفقة يعتبر بديل عن المدين، غير أن المشرع لم يكن منصفا حيث: * استثنى فئة كبيرة من الأطفال المحتاجين للمساعدة الاجتماعية من هذا الصندوق (مجهولي النسب، ذوي الاحتياجات الخاصة ... ) ، كما استثنى المطلقات والمعوزات والمتوفى عنهن أزواجهن، .... لذا على المشرع إعادة النظر في أحكام هذا القانون حتى يتسنى لجميع الأطفال المحضونين استيفاء نفقتهم. الكلمات المفتاحية: الطفل، الحضانة، صندوق النفقة. Abstract: The child is considered to be the most victimized from familly member from parental divorce, because he or she will be affected mentally and physically, such as being deprived from his or her child support with all its forms. This latter has become the most common case in Algerien court, which led the legislator to prevent the aggravation of the problem of parental support as soon as possible by using the court's alimony fund to: 1-Maintain family stability and lift embarrassment on the divorcee and her child in case the father is unable to pay the child supports, because the alimony fund is considered an alternative to the debtor. However the legislator was not fair because: * He or she excluded a large group of children who need social assistancef from the alimony fund, such as those of unknown parentage, people with special needs, and others. * He or she also excluded divorcees, widows, and needy women etc. Therefore, the legislator must urgently review the provisions of this law so that all foster children can benefit from their child support. key words: Child, custody, alimony fund. | en_US |
