| dc.description.abstract | تطرقنا في هذه المذكرة إلى وسائل حماية الضمان العام الذي احتل مكانة جد بارزة ضمن الدراسات القانونية، حيث تتمثل هذه الوسائل في أربع دعاوى هي: الدعوى غير المباشرة والتي يرفعها الدائن نيابة عن مدينه إذا أهمل هذا الأخير في المطالبة بحقوقه لدى الغير، والدعوى المباشرة يرفعها الدائن باسمه الشخصي على مدين مدينه في حالات محددة ليتمكن بواسطتها من الحصول على حقه مباشرة دون مزاحمة من باقي الدائنين، والدعوى البوليصية ودعوى الصورية وبهما يدفع الدائن عن نفسه غش المدين إذا عمد إلى التصرف في أمواله تصرفا جديا أو صوريا. إضافة إلى هذه الدعاوى الأربعة هناك وسيلة أخرى أيضا تتمثل في الحق في الحبس، وهو حق خوله القانون للدائن الذي يكون مدينا في نفس الوقت لحبس الشيء لديه حتى يستوفي كامل حقه. In this memorandum, we discussed the means of protecting the general security, which has occupied a very prominent position within the legal studies, as these means are represented in four lawsuits: In his personal name against a debtor in specific cases, in order for him to be able to obtain his right directly without competition from the rest of the creditors, the police suit and the fictitious lawsuit, in which the creditor pays for himself the debtor’s fraud if he deliberately disposes of his money in a serious or fictitious manner. In addition to these four lawsuits, there is another method as well represented in the right to imprisonment, which is a right granted by law to a creditor who is in debt at the same time to confine the thing in his possession until he fulfills his full right. | en_US |
