| dc.description.abstract | ن القانون الجزائري یو افق الفقه الإسلامي في تعریفه لمبدأ الشرعیة الجنائیة، وكذلك فیما یخص الشرعیة الإجرائیة والموضوعیة و المبدأ العام للأعمال الطبیة، إلا أنه یخالف الفقه الإسلامي في شرعیة التنفیذ العقابي ، الدفاع الشرعي، مصادر التشریع، تفسیر النصوص الجنائیة، تعطیل مبدأ الشرعیة الجنائیة بأسباب الإباحة، تنفیذ الموظفین للقانون، التأدیب، و الألعاب الریاضیة، ذلك ما جعل مبدأ الشرعیة في القانون الجزائري یثبت عدم فاعلیته عند تطبیقه على أرض الواقع، وضعفه في محاربة الجریمة والحد منها، لذلك وجب التوصیة بتفعیل المادة الثانیة من الدستور، التي تنص على أن الإسلام دین الدولة، وذلك باعتماده المصدر الأول في التشریع، لأن التشریع الإسلامي هو الأسمى والاكثر فعالیة، وخالي من العیوب، بالإضافة إلى أنه تشریع إلاهي سلیم من التحریف، مما یجعله تشریع موضوعي بحت، لا تشوبه أي ذاتیة أو أجندة. Summary of the memorandum The Algerian law aligns with Islamic jurisprudence in its definition of the principle of criminal legality, as well as with regard to procedural and substantive legality, and the general principle of medical acts, However, it contradicts Islamic jurisprudence regarding the legitimacy of punitive enforcement, legitimate defense, sources of legislation, interpretation of criminal texts, undermining the principle of criminal legality through reasons of permissibility, law enforcement by officials, disciplinary actions, and sports, This is what made the principle of legitimacy in Algerian law prove its inefficiency when applied in reality, and its weakness in combating and reducing crime. Therefore, it is necessary to recommend activating the second article of the constitution, which states that Islam is the religion of the state, and that it should be the primary source of legislation, Because Islamic legislation is the most supreme and effective, free from flaws, and derived from Allah without any distortion, it becomes a comprehensive objective legislation without any subjectivity or agenda | en_US |
