| dc.description.abstract | أولى المشرع الجزائري مسألة حماية حقوق المؤلف أهمية بالغة من خلال طرحه لمجموعة من القوانين كان آخرها الأمر03-05 وهو الأمر الذي دعمه بالعديد من النصوص التنظيمية، ولعل أهم ما يمكن تلخيصه موضح في النقاط التالية: - يعتبر مؤلف مصنف أدبي أو فني الشخص الطبيعي الذي أبدعه حسب الأمر 03-05، كما يمكن اعتبار الشخص المعنوي مؤلفا في الحالات المنصوص عليها في هذا الأمر. - يعتبر مالكا لحق المؤلف، مالم يثبت خلاف ذلك، الشخص الطبيعي أو المعنوي الذي يصرح بالمصنف باسمه أو يضعه بطريقة مشروعة في متناول الجمهور، أو يقدم تصريحا لدى الديوان الوطني لحقوق المؤلف والحقوق المجاورة المذكور في المادة 131 من هذا الأمر. - إذا تم نشر المصنف دون اسم مؤلفه، فإن الشخص الذي يضعه بطريقة مشروعة في متناول الجمهور يعد ممثلا لمالك الحقوق إذا لم يثبت خلاف ذلك. - يتولى الديوان الوطني لحقوق المؤلف والحقوق المجاورة ممارسة حقوق المصنف المنشور مجهول الهوية إلى أن يتم التعرف على هوية مالك الحقوق الأصلي. ABSTRACT : Protection of copyrights is a very important issue to the Algerian legislator through setting a set of laws and the last one has been the order 03-05. This order was assisted by the legislator through several organisational texts. Perhaps, the most important of what can be summarised is clarified in the following points: - The normal person, who creates a literary or artistic work, is considered as the author of that work according to the order 03-05, also the legal person can be considered as an author in the cases mentioned in this order. - The normal person or the legal one who declares the work under his name, publishes it legally, or makes a declaration at the National Bureau of Copyrights and Neighbouring Rights, which is mentioned in the article 131 of this order, is considered as the owner of copyrights if the opposite has not been proved. - If the work is published without the name of its author, the person who publishes it legally is considered as the representative of the rights owner if the opposite has not been proved. - The National Bureau of Copyrights and Neighbouring Rights enjoys the rights of the published anonymous work until the identity of the original rights owner is recognised. | en_US |
