| dc.description.abstract | إن إبرام الصفقات العمومية وفقا لإجراء طلب العروض ومن خلال دراستنا للمستجدات التي جاء بها المشرع الجزائري في المرسوم الرئاسي 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، انتقل من تسمية ونظام المناقصة التي تضمنتها التنظيمات السابقة إلى تسمية ونظام طلب العروض، كما حدد وعدِّد أشكاله، حيث أعاد ضبط المصطلحات والتعريفات والمفاهيم، واعتمده كإجراء يشكل القاعدة العامة لإبرام الصفقات العمومية، وألزم المصلحة المتعاقدة باتباع الإجراءات الشكلية لاختيار أحسن عرض من حيث المزايا الاقتصادية، بتوسيع وتعديد معايير واعتبارات الاختيار التقنية والفنية وليس المالية فقط، تكريسا للمبادئ العامة المنصوص عليها في المادة 05 منه، وتحقيقا للمصلحة العامة والحفاظ على المال العام. الكلمات المفتاحية: طلب العروض، الصفقات العمومية، مناقصة. Abstract : The conclusion of public procurements according to the request for proposals procedure and through our study of the developments brought by the Algerian legislator in Presidential Decree 15-247 containing the regulation of public deals and authorizations of the public utility, moved from the designation and system of tenders included in the previous regulations to the naming and system of the request for proposals, as it specified and number of its forms. Where he reset the terms, definitions and concepts, and adopted it as a procedure that constitutes the general rule for concluding public deals, and obligated the contracting authority to follow the formal procedures to choose the best offer in terms of economic advantages, by expanding and enlarging the criteria and considerations of technical and technical selection, not just financial, in consecration of the general principles stipulated in Article 05 of it, in order to achieve the public interest and preserve public money.
