| dc.description.abstract | إذا تم إبرام عقد البيع فإنه ينشأ حقوق والتزامات بين أطرافه ومن هذه الالتزامات، الالتزام بضمان التعرض والاستحقاق وضمان العيوب الخفية. فيلتزم البائع بموجب عقد البيع بالامتناع عن كل فعل من شأن منازعة المشتري في حيازة المبيع أو حرمانه من أي حق ترتب له بموجب هذا العقد، فإذا التزم بنقل ملكية المبيع إلى المشتري فانه يعتبر ضامنا لهذا النقل، ومن التزم بالضمان امتنع عليه التعرض سواء كان التعرض ماديا أو قانونيا، وإذا كان البائع يلتزم بضمان التعرض من الغير فانه يلتزم من باب أولى بأن لا يكون هو مصدر هذا التعرض، أما ضمان الاستحقاق يعد التزاما احتياطيا ويكون في حالة ماتعذر على البائع تنفيذ التزامه بضمان التعرض تنفيذا عينيا. العيوب الموجبة للضمان هي العيوب الخفية والمؤثرة التي يفترض وجودها قبل التسليم بحيث تجعل المبيع غير صالح للاستعمال المخصص له، إذ بمجرد توافرها يجب على المشتري أن يرفع دعواه في أجل سنة حسب المادة 383 بإتباع مجموعة من الإجراءات التي ألزمها المشرع عليه في آجال معقولة وإلا سقط حقه في رقع دعوى الضمان.
