Abstract
ملخص :
مرت الجريمة الإلكترونية بعدة مراحل تاريخية مختلفة فوصلت إلى درجة عالية من تطور وذلك بتطور تكنولوجيا وبتطورها وتغييرها يصعب على التشريعات إيجاد مفهوم متفق عليه حيث تأرجحت تعاريفها بين التعريفات الواسعة والضيقة ولكنها لم تتخلف عن تصدي لها وكافحتها بأحدث الطرق ، أما بالنسبة للمشرع الجزائري فقد تطرق إلى تعريف الجريمة الإلكترونية مسميا إياها بجريمة المساس بأنظمة المعالجة الآلية للمعطيات .
أما بالنسبة لأركان هذه الجريمة لا تختلف عن أركان الجريمة التقليدية المتعارف عليها والمتمثل في الركن الشرعي وهو النص القانوني بوجود تثبت الجريمة وأما الركن المادي فهو السلوكات الإجرامية المحدد بنص القانوني والركن المعنوي يدور حول القصد الجنائي لهذه الجريمة.

Cybercrime has gone through several different historical stages, reaching a high degree of development, with the development of technology and its development and change.
