Abstract: Custody is considered one of the sensitive and important issues in family life as custody of the child is granted to one parent or another person who takes full care of his health morals and welfare. In this context the concept of custody in Algerian law is based on the Islamic concept which gives preference to the mother in cases of guardianship and custody in the family. Our study was presented to discuss custody in Algerian legislation by studying its various aspects beginning with its definition conditions and arrangement of those entitled to it according to the law. The Algerian family with a discussion of its duration and the reasons for its fall expiration and return. | |
