| dc.description.abstract | ملخــــص : لقد خول المشرع الجزائري للنيابة العامة الحق في التدخل كطرف أصلي في جميع القضايا المتعلقة بشؤون الأسرة، بصريح نص المادة 03 مكرر من قانون الأسرة، وقد أثار تطبيق نص المادة عدة إشكالات وغموض من الناحية العملية، إلى حين صدور قانون رقم 08/09 المتعلق بقانون الإجراءات المدنية والإدارية المؤرخ في 25 فبراير 2008 الذي حاول من خلاله المشرع إزالة الغموض حول هذه المسألة،بأن حدد تدخل النيابة العامة بكل دقة في القضايا المدنية بصفة عامة، وفي القضايا المتعلقة بشؤون الأسرة بصفة خاصة، وفقا لنص المادة 256 التي خولت للنيابة العامة الحق في الإدعاء كطرف أصلي أو التدخل كطرف منضم. Abstract : Algerian legislator has authorized to the public prosecutor the right to intervene as a party in the all original issues relating to famili affairs, as explicitly shown in the texte of article 03 bis of the Family Law. In practice,the application of the text of the article has many effects as the ambiguity and the emergence of serveral problematics, until the enactment of the law No: 08/09 on civil law and administrativ procedures dated on February 25 th 2008, Through which the legislator tried to demystify the ambiguity on thi issue, that the intervention of the public prosecutor is strictly identified on issues in general,and in issues related to famili matters, in particular in accordance with the provisions of Article 256 which permitted the public prosecutor the right to claim as original party or to intervene as a joined pa | en_US |
