Abstract
تعد الممارسة النقابية في قطاع الوظيفة العمومية من المواضيع الأساسية والمهمة في الدولة المعاصرة كونها أضحت من الأدوات العقلانية الرشيدة التي ترتكز عليها الدول في بناء مؤسساتها وتحقيق توازنها من خلال إعتبار النقابات شريكا إجتماعيا يعول عليه في إعداد سياسات تنموية رشيدة، وهذا في ظل إتساع نشاط المرفق العمومي الذي افضى بالظرورة إلى زيادة فئة الموظفينن العموميين ، لهذا وجب علينا دراسة هذا الموضوع من زاويته القانونية
فجاءت هذه المذكرة للوقوف بالتحليل على المعالجة التشريعية في الجزائر لموضوع الحق النقابي ومدى فعاليتهاعلى ممارسته في قطاع الوظيفة العمومية ، هذا الحق الذي حظي بالتكريس في جل الدساتير التي عرفتها الدولة الجزائرية منذ الإستقلال بعد أن كان مقيدا في الفترة الإستعمارية، إذ و بعد أن كان الحق النقابي بٌعيد الإستقلال منطوٍ فقط تحت غطاء واحد وهو الإتحاد العام للعمال الجزائريين الذي يعتبر جهازا من أجهزة حزب جبهة التحرير الوطني، والذي لم يمنح الحق في الإضراب إلا لفئة الخواص، جاء دستور 1989 ليطلق مبدأ التعددية النقابية على غرار التعددية الحزبية، ثم تلته العديد من القوانين المنظمة لطريقة ممارسته في قطاعات الوظيفة العمومية، وهو الأمر الذي أغنى الساحة النقابية بالعديد من التنظيمات النقابية المستقلة والتي تتفاوت فعالية ممارستها النقابية من نقابة إلى أخرى بحسب تجاوزها للصعوبات والعراقيل التي تواجهها بنوعيها الداخلية والخارجية ، وبدراستنا لنموذج المجلس الوطني المستقل لمستخدمي التدريس للقطاع ثلاثي الأطوار للتربية CNAPESTE الذي يعتبر نقابة فاعلة في قطاع التربية نجحت إلى حد كبيرفي تحقيق مجموعة من المكاسب المهنية من خلال طريقة ممارستها النظالية المدروسة والمستمدة من قواعدها النضالية ،ورغم ذلك لم تحظى بالإعتراف كشريك إجتماعي من قبل السلطة.
وعليه يمكننا القول أن المعالجة التشريعية للحق النقابي لم ترقى إلى المستوى المرجو في تفعيل الممارسة النقابية من خلال تمثيل الموظفين والدفاع عن حقوقهم ، وأن حرية هذه الممارسة لا تزال في مواجهـة مجموعة من العراقيل والتحديات التي تفرضها سياسة الحكومات ، كما أن مخرجات التجربـة التفاوضـية في بلادنـالا تزال في نقطة بعيدة عن المستوى المرجو من الممارسة النقابية .
Summary
The syndicate union practice in the civil service sector is one of the basic and important issues in the modern state, as it has become one of the rational tools upon which states rely in building their institutions and achieving their balance by considering syndicate unions a reliable social partner in preparing rational developed policies. The expansion of the public service’s activity necessarily led to an increase in the public servants. That’s why we must study this issue from its legal side.
This study came to find out an analysis of the legislative treatment of the issue of the right to syndicate union in Algeria and its effectiveness in exercising it in the civil service sector. This right which was preserved in most of the constitutions was known to the Algerian state since independence after it was restricted in the colonial period, and it was known as the General Union of Algerian Workers, which was considered a member of the National Liberation Front, which only granted the right to strike to the private class.T he 1989 constitution came to launch the principle of syndicate union pluralism similar to party pluralism, followed by many laws regulating the way it is practiced in the sectors of the public office; our study is about the CNAPESTE model, which is considered an active union in the education sector, which has largely succeeded in achieving a set of professional gains through the method of its studied theoretical practice derived from its struggle bases, and yet it was not recognized as a social partner by the authority.
Accordingly, we can say that the legislative treatment of the right to union has not lived up to the desired level in activating the syndicate union practice by representing employees and defending their rights, and that the freedom of this practice is still facing a set of obstacles and challenges imposed by the governments policy, and the outcomes of the negotiation experience in our country are still far from the desired level of the syndicate union practice.
