Abstract
الصفقة العمومية مثلها مثل باقي العقود الإدارية تبرم ومن ثم تنتهي إما نهاية طبيعية أو نهاية غير عادية أو كما تسمى هذه الأخيرة بالنهاية المبسترة ، أما النهاية الأولى و هي النهاية العادية الطبيعية ، منطقيا و بدون تعقيدات قد تنتهي بنهاية المدة المتفق عليها أو تنتهي نهاية عادية بتنفيذ موضوع العقد ، أثناء التفيذ للطرفان كل الحرية في استعمال حقوقهم في مواجهة دلك عليهم التحلي بالالتزامات القانونية ، لكي يتم التنفيذ المالي و التنفيذ الإداري على أتم و أحسن وجه ، و تنتهي عملية التنفيذ بالاستلام مؤقتا كان أو نهائيا، أما الحالة الثانية التي قد تؤدي إلى نهاية الصفقة هي النهاية غير العادية ، فتكون إما بالفسخ الجزائي سواء كان قضائيا أو بقوة القانون ، أو الفسخ التقديري إداريا كان أو اتفاقيا .

The public deal, like the rest of the administrative contracts, is concluded and then ends with either a natural end or an unusual end, or as the latter is called a scalded end. The subject of the contract, during the execution, the two parties are completely free to use their rights in the face of it, so they have to show legal obligations, so that the financial and administrative implementation is carried out in the most complete and best way, and the implementation process ends with receipt, whether temporarily or permanently, as for the second case that may lead to the end of the contract. The deal is the unusual end, so it is either through penal termination, whether judicial or by force of law, or discretionary termination, whether administrative or agreement
