dc.description.abstractيلاحظ أن قانون الاسرة الجزائري يخرج من حين إلى آخر عن المذاهب الأربعة في أحكام بعض مسائل الميراث المختلف فيها ، وباعتبار المذهب المالكي هو المعتمد في الجزائر إلا أن المشرع الجزائري لم يلتزم بما جاء به هذا المذهب التزاما تاما في بعض المسائل المختلف فيها كميراث الجد مثلا ، بل أخذ في العديد المرات من مذاهب أخرى . الكلمات المفتاحية : الاختيارات الفقهية – الميراث – المسائل المختلف فيها – المشرع الجزائري – قانون الأسرة الجزائري Summary : It is noted that the Algerian family law departs from time to time from the four schools of thought in the rulings on some issues of different inheritance, and considering the Maliki school of thought is adopted in Algeria, the Algerian legislator did not fully adhere to what this doctrine came with in some of the different issues in it, such as the inheritance of the grandfather, for example.
