| dc.description.abstract | إن التحكيم التجاري الدولي يعتبر من الأساليب الفعالة التي تؤدي دورا هاما في فض النزاعات التجارية الدولية، وذلك لما يتميز به من سرعة وسرية، وكذلك حرية الاطراف في اللجوء إليه، عن طريق اتفاقية التحكيم والتي من خلالها يتفق الاطراف على عرض نزاعهم القائم بينهم أو النزاعات المستقبلية على المحكمة التحكمية، والتي تصدر حكم تحكيمي تجاري دولي فاصل في النزاع، غير أن عمل هيئة التحكيم يخضع للرقابة القضائية الهدف منها التحقق من صحة كافة الاجراءات التي تتخذ في عملية التحكيم التجاري الدولي، بدءا من اتفاق الاطراف على اللجوء إليه، حتى صدور حكم التحكيم التجاري الدولي وتنفيذه. والمشرع الجزائري منح للطرف الذي صدر ضده حكم التحكيم التجاري الدولي في الجزائر الحق في رفع الدعوى ببطلانه، وذلك إذا كان معيبا بعيب من العيوب المنصوص عليها في المادة 1056 من قانون الاجراءات المدنية والإدارية الجزائري. ا Abstract International commercial arbitration is an effective method that plays an important role in resolving international trade disputes because of its speed and confidentiality as well as the freedom of parties to resort to it through the arbitration agreement through which the parties agree to present their dispute or future disputes.
