| dc.description.abstract | تعتبر سوق الأوراق المالية من أبرز وأهم الأسواق التي ظهرت حديثا نتيجة للتطور الاقتصادي والصناعي الذي مرت به معظم الدول في العالم، خاصة الدول المتقدمة. وبما أن البورصة تعتبر مقياس لضعف وقوة الاقتصاد لقيت إهتمام من طرف أغلب الدول، سواء المتطورة أو النامية، هذه الأخيرة تسعى هي الأخرى لنهوض باقتصاداتها من خلال هذه الآلية المستحدثة، غير أن المعاملات البورصية لا تخلو مثلها مثل المعاملات من الأفعال غير الشرعية الخطرة التي تمارس من طرف المحتالين الذين يسعون إلى الربح بشتى الطرق حتى وإن كانت تتنافى مع القانون. أما الجزائر فقد درست بورصة القيم المنقولة، سواء من الجانب الاقتصادي أو القانوني، حيث جرمت بعض الأفعال ووضعت عقوبات جزائية وإدارية مقابلة لها، فقد سنت بعض القوانين المتعلقة ببورصة الأوراق المالية أهمها القانون رقم 03-04 المتعلق ببورصة القيم المنقولة، وهذا كله من أجل الحماية المطلوبة للمتعاملين والعمل في بيئة تسودها الطمأنينة وبالتالي التمكن من المجال البورصي ونجاحه. الكلمات المفتاحية: جرائم، بورصة الأوراق المالية، الحماية القانونية، التشريع الجزائري. Abstract: The stock market is one of the most prominent and important newly emerging markets as a result of the economic and industrial development experienced by most countries in the world, especially developed countries. Since the exchange is a measure of the weakness and strength of the economy, most countries have received attention. The latter also seeks to boost its economies through this innovative mechanism. However, the Bursese transactions are not without much of the dangerous illegal acts of fraudsters seeking to profit in various ways, even if they are contrary to the law. Algeria has studied the Exchange of Values Transferred, both economically and legally. Certain acts have been criminalized and corresponding penal and administrative penalties have been imposed. Some laws relating to the Exchange of Securities have been enacted, the most important of which is Act No. 03-04 on the Exchange of Values Transferred, all for the purpose of protecting customers and working in a reassured environment and thus enabling the Bursa.
