| dc.description.abstract | عرف القطاع الفلاحي في الجزائر تطورا كبيرا من حيث إصدار القوانين من طرف المشرع الجزائري وذلك لضبط استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة. وفي ظل تعدد هذه القوانين نتج عنها منازعات في العقار الفلاحي حيث أصبحت هذه المنازعات من أكثر القضايا تعقيدا، لعدم وضوح النصوص القانونية التي تضبط هذه المنازعات خاصة في توزيع الاختصاص، ومع كثرة منازعات العقار الفلاحي أدى إلى تداخل الاختصاص بين القضاء العادي والقضاء الإداري مما جعل المشرع الجزائري يعتمد على المعيار العضوي والمعيار الموضوعي لتوزيع جهة الاختصاص. وتبقى هذه المنازعات تتميز بنوع من الخصوصية لارتباطها بالعقار الفلاحي لذا فان الفصل فيها يبقى على مستوى القضاء المزدوج،والذي يهدف الى حماية الفرد من جهة والمصلحة العامة من جهة اخرى. The agricultural sector in Algeria has witnessed a great development in terms of the issuance of laws by the Algerian legislator to control the exploitation of agricultural lands belonging to the private property of the state. In light of the multiplicity of these laws that resulted in disputes in the agricultural real estate, where these disputes became one of the most complex issues, due to the lack of clarity in the legal texts that control these disputes, especially in the distribution of jurisdiction, and with the large number of agricultural real estate disputes, this led to the overlap of jurisdiction between the ordinary judiciary and the administrative judiciary, which made the legislator Algerian relies on the organic criterion and the objective criterion for the distribution of the jurisdiction. These disputes remain characterized by a kind of privacy as they are related to agricultural real estate, so the settlement of them remains at the level of the dual judiciary, which aims to protect the individual on the one hand and the public interest on the other | en_US |
