| dc.description.abstract | ملخص الدراسة: إن للمساهم مجموعة من الحقوق المالية، والتي لها أهمية كبيرة بالنسبة له، حيث خولت له التدخل بشكل مستمر في حياة الشركة، إلا أن كثرة المساهمين في الشركة يجعل مصالحهم مختلفة،فهذا الاختلاف يحدث التنازع بينهم ، لذا يصبح من الضروري تطبيق مبدأ المساواة من أجل خلق التوازن بين عدم الإضرار بحقوق المساهمين، كما أن حماية المساهم لحقوقه المالية داخل الشركة تكمن في ضمان حصوله على الأرباح ومنحه كامل الحرية لتداول أسهمه داخل الشركة. إلا أن المشرع ضمن عدة آليات لحماية المساهم وذلك بتوفير حماية كاملة، من أي تعسف داخل الشركة، وذلك بفرض عقوبات جزائية على المخالفين. الكلمات المفتاحية: المساهم، حق التصويت، المساواة، التداول، الحماية الجزائية . Abstract: The shareholder has a set of financial rights, which is of great importance to him, as it has been authorized to intervene continuously in the life of the company, but the large number of shareholders in the company makes their interests different, this difference causes conflict between them, so it becomes necessary to apply the principle of equality in order to create a balance between not harming shareholders' rights, and the protection of the shareholder's financial rights within the company lies in ensuring that he receives profits and gives him full freedom to trade his shares within the company. However, the legislator has included several mechanisms to protect the shareholder by providing full protection, from any abuse within the company, by imposing punitive penalties on violators.
