| dc.description.abstract | تعتبر الوظيفة العامة والفساد الاداري من بين أىم المواضيع التي تستقطب الباحثين في العلوم القانونية، حيث تهدف ىذه الدراسة الى تحليل المداخيل الاساسية لهذين المفهومين، ومن خلال دراستنا المتواضعة ىذه حاولنا التطرق الى مفهوم الفساد الاداري واسبابو والأثار المترتبة على ىذه الظاىرة التي تنخر جسم المجتمع وقطاع الوظيفة خاصة، ىذا القطاع الذي منو يبدأ ما يسمى بالفساد الاداري حيث يقوم بو الموظف في قطاع العمومية والذي يستغل مركزه القانوني للقيام بو لهذا ارتأينا ان نعرف الوظيفة والموظف العام وكذا النظام الوظيفي المطبق في أغلب الدول لكي نكون مفاىيم قانونية صحيحة حول ىذا الموضوع، كما قمنا بدراسة المبادئ التي تقوم عليها الوظيفة العمومية ومدى تكريسها على أرض الواقع وىذا بناءا على الامر 60/60 القانون الساري المفعول وىذا بالتدقيق والتفحص لهذا الامر حيث جاء ىذا الامر ليدعم كل من المبادئ التالية :مبدأ المساواة والجدارة وكذا مبدا المشاركة والحوار وصولا الى مبدأ التوفيق بين ضمانات الوظيفة العامة والسير الحسن للإدارة العمومية وبهذا جعل ىذا الامر كل وجل ىذه المبادئ مبادئ مهمة في تسيير شؤون الوظيفة العمومية وىذا كلو نستطيع اعتباره ضمانات أساسية للموظف والوظيفة ككل. 65 The summary : The public function and administrative corruption are among the most important topics that attract researchers in legal sciences, as this study aims to analyze the basic incomes of these two concepts, and through our modest study, we tried to address the concept of administrative corruption, its causes and the effects of this phenomenon that erodes the body of society and the sector The job is in particular , this sector from which the so-called administrative corruption begins, where it is carried out by the employee in the public sector and who takes advantage of his legal position to do it.
