Summary: The enactment of the new Investment Law of 2016 serves as a powerful message towards the final liberalization of the investment area in the light of the text of article 43 of the 2016 Constitution, but after a few years of application of both constitutional and legislative text, it appears that the envisaged results were not timely. However, all the efforts made by Algerian legislation are insufficient to entice the foreign investor, owing to a variety of reasons. The most important of these guarantees may be accompanied by a series of exceptions and restrictions to their practice, particularly with regard to the conditions for capital movements, which are sensitive to the foreign investor. This study is therefore designed to identify the most important restrictions on foreign investment under 16-09 law.
