dc.description.abstractتبحث الدراسة الحالية في أهمية مبدأ المنافسة في ضمان الشفافية والعدالة، وتحقيق أفضل قيمة ممكنة للمال العام، ولضمان ذلك أوجد المشرع الجزائري نظام التراضي بنوعين البسيط وبعد االستشارة في إبرام الصفقات العمومية سعيا منه لتعزيز المنافسة بين المتعاقدين، من خالل تشجيعهم على تقديم عروض منافسة وتحسين الخدمات المقدمة من خالل تسليط الضوء على مرونة التراضي في عملية إبرام الصفقات العمومية، بحيث يمكن للمتعاقدين التفاوض والتوافق على شروط العقد بطرق مختلفة من خالل المرسوم 742-51 الذي ضمن المنافسة في إجراء التراضي على عكس التشريعات السابقة، حيث يهدف من وراء ذلك إلى الحد من حدوث الفساد في عملية إبرام الصفقات العمومية، من خالل تقليل فرص التالعب والتمييز غير المبرر. الكلمات المفتاحية: الصفقات العمومية، التراضي البسيط، التراضي بعد االستشارة، مبدأ المنافسة Summary: Current study examines the importance of competition principle in ensuring transparency and justice and to achieve the best possible value for public money, to ensure this Algerian legislator created a system of mutual compromise of two simple types and after consultation in the conclusion of public transactions in an effort to promote competition between contractors by encouraging them to make competitive offers and improve the services provided by highlighting consensual flexibility in the process of concluding public transactions, so that contractors can negotiate and agree to the terms of the contract in different ways through Decree 15-247 which ensured competition in the consensual procedure unlike previous legislation programme ", which aims to reduce corruption in the process of concluding public transactions by reducing opportunities for manipulation and unjustified discrimination Keywords: public deals, simple compromise compromise after consultation, competition principleen_US
