Abstract
هدفت الدراسة الحالية إلى فهم الضمانات القانونية والتنظيمية المتاحة للمتعاملين االقتصاديين في عقود الصفقات العمومية
في التشريع الج ازئري، وتحليل أثر تلك الضمانات على جودة عقود الصفقات العمومية وكفاءة استخدام الموارد العامة، و تقييم
فعالية اآلليات المستخدمة لتطبيق الضمانات وإدارة المخاطر في العقود العمومية، ودراسة مدى تأثير الضمانات على تعزيز
الثقة بين القطاعين العام والخاص وتحفيز المشاركة في عقود الصفقات العمومية.
خلصت الدراسة إلى مجموعة من النتائج، منها أن وجود ضمانات قانونية وتنظيمية للمتعاملين االقتصاديين في عقود الصفقات
العمومية يساهم في تعزيز الشفافية، وتحسين النزاهة، وتعزيز المنافسة العادلة، كما كشفت الدراسة عن وجود تحديات عديدة
تواجه تنفيذ الضمانات، مثل التحديات اإلدارية والتنفيذية والفساد، والتي تستوجب التدخل ال ال لتجاوزها

Abstract:
The current study aimed to understand the legal and regulatory guarantees available to
economic operators in public procurement contracts under Algerian legislation, analyze the
impact of these guarantees on the quality of public procurement contracts and the efficiency of
public resource utilization, evaluate the effectiveness of the mechanisms used to apply the
guarantees and manage risks in public contracts, and examine the extent to which these
guarantees enhance trust between the public and private sectors and encourage participation in
public procurement contracts.
The study concluded with several findings, including that the presence of legal and regulatory
guarantees for economic operators in public procurement contracts contributes to enhancing
transparency, improving integrity, and promoting fair competition. The study also revealed
numerous challenges facing the implementation of these guarantees, such as administrative and
executive challenges and corruption, which require effective intervention to overcome.
Furthermore, the study showed that reliable guarantees in public contracts increase trust
between the public and private sectors, thereby boosting investment and economic
development.
