Abstract
إن توافر بعض الظروف الاجتماعية والاقتصادية السيئة وحتى الشخصية وغيرها من العوامل المحيطة بالحدث يؤدي إلى الانحراف والذي يؤدي هو الاخر للوقوع في خطر الجنوح والاجرام كون هذا الاخير سهل التأثر نظرا لأنه عديم أو ضعف التمييز والادراك وحريته في الاختيار محدودة جدا.وهو ما يؤدي إلى قيام المسؤولية الجزائية للحدث وتوقيع عقوبات وتدابير ضده رغم صغر سنه، غير ان هذه التدابير والعقوبات تختلف باختلاف سنه فقد يعفىتماما من المسؤولية ان كان دون 10 سنوات وقد يكون محل تدابير فقط أو تدابير وعقوبات مخففة ويكون ذلك بالنسبة للحدث بين 10 سنوات الى18 سنة.
ورغم التشابه بل وعدم التمييز في بعض الأحيانفي إجراءات المتابعةفي جميع المراحل ضد الحدث الجانح وضد المجرم البالغ غير أن المشرع الجزائري منح للحدث المرتكب للجريمة عدة ضمانات سواء كان ذلك في مرحلة التحقيق أو المحاكمة وحتى داخل مؤسسات إعادة التربية التي يتم إيواء الحدث الجانح فيها.والهدف من قيام مسؤوليته الجزائية وتوجيه له عقوبات واخضاعه لتدابير حماية وتهذيب هو التهذيب والعلاج واستئصال الخطورة الإجرامية الموجودة داخله إن صح التعبير قبل أن تتأصل فيه وليس الزجر والعقاب لأنه ضحية ظروف كما اسلفنا الذكر
Abstract:
The availability of somebad social and economic conditions and evenpersonal and otherfactorssurrounding the event leads to deviation, whichalso leads to fallinginto the risk of delinquency and criminality, as the latter iseasilyaffected due to the lack or weakness of discrimination and awareness, and hisfreedom of choiceisverylimited. Which leads to the establishment of the criminalresponsibility of the juvenile and the imposition of penalties and measuresagainsthimdespitehisyoungage. However, thesemeasures and penalties varyaccording to hisage. He maybecompletelyexemptedfromliability if heisunder 10 years and maybe the subject of measuresonly or measures and mitigating penalties, and thisis for the juvenilebetween 10 years to 18 yearsold.
Despite the similarity and sometimes the lack of discrimination in the follow-up procedures at all stages against the juveniledelinquent and against the adultcriminal, the Algerian legislatorgrantedseveralguarantees to the juvenilewhocommitted the crime, whether at the stage of investigation or trial, and evenwithin the re-education institutions in which the delinquentjuvenileishoused. The aim of assuminghispenalresponsibility, directing penalties to him, and subjectinghim to measures of protection and discipline, is to discipline, treat, and eradicate the criminal danger thatexistswithinhim, so to speak, beforeitbecomesrooted in him, and not reprimand and punishmentbecauseheis a victim of circumstances as mentionedabove.
