| dc.description.abstract | هذا البحث بواحد من الموضوعات المهمة،ذات الصلة بواقع المجتمع،ألا وهو التراضي في عقد الزواج بين الفقه الاسلامي وقانون الأسرة الجزائري،حيث تطرقت فيه إلى بيان أهمية ركن الرضا في الزواج وخصوصيته ،انطلاقا من النصوص الشرعية وأقوال الفقهاء الصريحة في وجوب اعتباره في كل العقود بصفة عامة وفي صحةالعقد بين الزوجين بصفة خاصة،وانتهاء بنصوص قانون الأسرة الجزائري المؤكدة عليه،حيث استعرضت فيه موقف الفقه الاسلامي بمذاهبه الأربعة،وموقف المشرع الجزائري. وقد تناولت فيه مفهوم الرضا، وضوابطه، وشروط صحته، وطرق التعبير عنه، وبينت بعض ما يتوهم أنه من عيوبه،من خلال التطرق إلى الإجبار والعضل ،فذكرت ما يجوز فيهما وما لا يجوز في الفقه والقانون، ثم تحدثت عن عيوب الرضا مركزا على التغرير كأحد أهم صوره الشائعة في عقد الزواج؛ أين استعرضت فيه مفهومه وحكمه ودليله وأنواعه وآثاره،ثم تناولت في ختام البحث أهم النتائج والتوصيات التي توصلت إليها. الكلمات المفتاحية: العقد- الزواج- الأسرة- الرضا-الفقه الاسلامي- القانون- الإجبار - العضل- الخيار -الفسخ. Research Abstract: This research deals with one of the important topics related to the reality of society, namely, the concurrence in the marriage contract between Islamic jurisprudence and the Algerian family law, in which it touched upon the importance of the corner of satisfaction in marriage and its privacy. The contracts in general and the validity of the contract between the spouses in particular, and the texts of the Algerian family law confirmed, where reviewed the position of Islamic jurisprudence in its four stages, and the position of the Algerian legislator I mentioned the concept of consent, its controls, the conditions of its validity, and the ways of expressing it, and showed some of the illusions that it is a defect, by addressing the coercion and prevention, I mentioned what is permissible and what is not permissible in jurisprudence and law, The most important form common in the marriage contract; where I reviewed the concept and governance and evidence and types and effects, and then dealt at the end of the research the most important findings and recommendations reached. key words:Contract - marriage - family - satisfaction - Islamic jurisprudence - law - coercion - prevention - option - dissolution | en_US |
