| dc.description.abstract | يعد عقد الكفالة من أبرز العقود شائعة الاستخدام في الوقت الحالي، لأنه يوفر للدائن الأمن والطمأنينة في استيفاء حقه عند حلول الأجل، كما له خصائص مميزة تميزه عن بعض الأنظمة المشابهة وكذا له أنواع، وعقد الكفالة كباقي العقود لابد من توافر أركان حتى ينشأ صحيحا. ويترتب على عقد الكفالة آثار قانونية بين الدائن والكفيل وبين المدين والكفيل، أما بخصوص الانقضاء فعقد الكفالة .ينقضي بطريقة تبعي (أي ينقضي تبعا لإنقضاء الالتزام الأصلي) كما قد ينقضي بطريق أصلي مستقل عن انقضاء الالتزام الأصلي كما قد ينقضي لأسباب خاصة قد تم ذكرها. General summary The bail contract is one of the most useful contracts Nowadays, because it Provides security and tranquility of mind for the creditor in fulfilling his right when the deadline arrives. Addition to this it contains features that make it distinguish from other similar systems. And also it is divided into types .the bail contract is like all other contracts, it should contains conditions in order to arrives correctly . The bail contract is followed by legal effects between the creditor and the guarantor the debtor and guarantor.
