| dc.description.abstract | الشخص الطبيعي وأنواعها وأقسامها وتعرفنا على العوارض التي تصيب الشخص الطبيعي وفرقنا بين مصطلح العوارض وموانع الأهلية كما تناولنا جل التصرفات التي يقوم بها الشخص الطبيعي وأحكامها تبعا لكل مرحلة من مراحل تدرج أهليته كما تعرفنا على آليات أوجدها المشرع حماية لناقص وعديم الأهلية ،مثل الحجر والقوامة والنيابة الشرعية . -كما توصلنا من خلال بحثنا وكإجابة لإشكالية بحثنا ، ومن خلال تحليلنا لأهم مواد القانون المدني وقانون الأسرة بخصوص هذا الموضوع أن المشرع الجزائري باستثناء ما ذكرنا من هفوات وفق إلى حد بعيد في صياغة أحكام وقواعد الأهلية لأنه استنبط أغلب الأحكام من الفقه الإسلامي خاصة المذهب المالكي في أغلب المواد القانونية المتعلقة بهذا البحث وهذا ما يبرز أصالة الشريعة الإسلامية وأنها صالحة في كل زمان ومكان . Summary : As a summary of our research on the issue of eligibility, we say that we were able to identify the nature of the capacity of a natural person, its types and divisions, and we got acquainted with the symptoms that afflict the natural person, and we distinguished between the term symptoms and contraindications to eligibility. The legislature created it to protect the deficient and incompetent, such as stone, guardianship and legal prosecution. - We have also found, through our research and as an answer to the problem of our research, and through our analysis of the most important articles of civil law and family law regarding this subject, that the Algerian legislator, with the exception of what we have mentioned of lapses, is largely in accordance with the formulation of the provisions and rules of eligibility because he derived most of the provisions from Islamic jurisprudence, especially the Maliki school of thought. Most of the legal materials related to this research are what highlights the originality of Islamic law and that it is valid in all times and places. | en_US |
