| dc.description.abstract | تمحور مضمون المذكرة حول المركز القانوي لرئيس المجلس الشعبي البلدي واشكالية تجسيد هذا الاخير لنظام اللامركزية بصورة حقيقية من خلال الصلاحيات الممنوحه له بمقتضى قانون البلدية 11/10 وقد قسمنا البحث الى فصلين. فصل أول تناولنا فيه النظام القانوني لرئيس المجلس الشعبي البلدي تحديدا كيفية التعيين بمختلف مراحلها من الترشح الى الإنتخاب متناولين في ذلك الشروط الشكلية والموضوعية لعملية التعيين . أما الفصل الثاني تطرقنا فيه الى اختصاصات رئيس المجليس الشعبي البلدي بصفته ممثلا للبلدية من خلال سهره على تسيير مختلف مصالح البلدية سواء من الجانب البشري أو تسيير المرفق العام التابع للبلدية . ثم بصفته ممثلا للدولة ودوره كضابط للحالة المدنية من جهة ومن جهة أخرى ضابط للشرطة القضائية إضافة الى صلاحياته في الضبط الإداري وكذلك اختصاصه في مجال التهييئة والتعمير. This dissertation evolved around the legal status of the president of the municipal people’s assembly and the problematic nature of the latter’s embodiment of the decentralization system in a real manner, through the powers granted to him under municipal law 10/11.This work is divided into two chapters, the first chapter tackled the legal status of the president of the municipal people’s assembly and specifically the different forms of appointment from candidacy till election, to meet the formal and objective condition of appointment. The second chapter dealt with the terms of reference of the head of the municipal assembly as a representative of the municipality through supervising the work of the various interests of the municipality, either from the human side or running the public utility. The second specification as a representative of the state is summarized in his role as an officer of civic situation in one hand and the officer of judicial police in the other hand. In addition to his powers in administrative control as well as his participation in the field of preparation and construction. | en_US |
