| dc.description.abstract | يكمنُ دورُ مجلسِ المنافسة في ترقيةِ مُناخِالأعمال في الجزائر في كونِه يعملُ على قمعِ ومعاقبةِ الممارساتِ المقيِّدةِ للمنافسة من الاتّفاقاتِالمحظورة، والتّعسُّفِ في القوّةِ الاقتصادية، ووضعيةِ الهيمنة أو التّبعية الاقتصادية، أو التّعسُّفِ في ممارسةِ بيعٍ بأسعارٍ منخفضة؛بكلِّ ما لهمن امتيازاتِ السُّلطةِ العامّة. غيرَ أنّنا نجد أنّ سلطتَهُ محدودة في مجالِ مراقبةِ السُّوق وتنظيمه. ويُعدُّ مجلسُ المنافسة محدِّدَ صاحبِ الاختصاصِ العامّ، إلى جانبِ سُلطاتِ الضّبطِ التي تعملُ بنفسِ طريقةِ مجلسِ المنافسة، لكنّها محدودةٌ في مجالِ نشاطٍ معيّن؛ ممّا جعلَ منهُ جهازًا أساسيًافي مجالِ تشجيعِ واستقطابِ الاستثمارات. A B S T R A C T The competition council's role in promoting Algeria's business climate lies in the fact that it suppresses and punishes restrictive practices of prohibited agreements, abuse of economic power, status of domination or economic dependency, or arbitrariness in the practice of selling at low prices, with all its privileges of public authority. However, we find that his authority is limited in the area of market control and regulation. The Competition Board is the determinant of the general jurisdiction, together with control authorities that operate in the same way as the Competition Board, but are limited in a particular area of activity, making it an essential organ in promoting and attracting investment. | en_US |
