| dc.description.abstract | يعتبر حكم التحكيم بمثابة النتيجة التي تتوصل إليها هيئة التحكيم بعد النظر في الدفوع وطلبات الخصوم ، وعقد جلسات استماع ومرافعة وسماع شهادة الشهود والخبراء ويأتي الحكم كنتيجة لا قناع الهيئة بالأدلة المقدمة من الخصوم . ولإصدار حكم التحكيم يجب ان تتبع الهيئة مجموعة من الإجراءات ، وتلتزم بالميعاد المحدد لها ، كما يمكن لهيئة التحكيم أن تصدر احكام جزئية او احكام أولية قبل إصدار الحكم المنهي للخصومة . فقد يصدر القرار من المحكمين وهو يحمل معه سببا من الأسباب التي تجعله باطلا ، وبالتالي يصبح كأن لم يكن ، وهي اسباب قد تتعلق بعقد التحكيم ،أو بأشخاصه ، أو تتعلق بإجراءات التحكيم أو لمخالفته النظام العام او لأسباب تتعلق بحكم التحكيم ذاته . The arbitral award is considered as the conclusion reached by the arbitral tribunal after considering the defenses and requests of the litigants, holding hearings, pleadings and hearing the testimony of witnesses and experts. In order to issue the arbitral award, the tribunal must follow a set of procedures, and abide by the deadline set for it, and the arbitral tribunal can issue partial rulings or preliminary rulings before issuing the ruling ending the litigation. The decision may be issued by the arbitrators, and it carries with it one of the reasons that make it invalid, and thus becomes as if it had not been, and these reasons may be related to the arbitration contract, or its persons, or related to the arbitration procedures, or to its violation of public order, or for reasons related to the arbitration award itself. | en_US |
