| dc.description.abstract | الأصل في العقود الرضائية، إن الرسمية هي الاستثناء الذي أقره المشرع في عقود ذات مزايا اقتصادية واجتماعية سماها العقود الرسمية وهي التي تنعقد أمام ضابط عمومي، أو موظف عام وفق إجراءات كتابية وتحريرية، اتفقت أغلب النظم والتشريعات على تبنيها، ولا يمكن دحض حجيتها إلا بالطعن بالتزوير فيها، وقد اختلف الفقهاء في تقسيمها إلى رسمية مباشرة وهي التي تعتبر ركنا في انشاء العقد ولها حجية باتة، وأخرى بمسمى الرسمية غير مباشرة وهي التي تعتبر ركنا في الاثبات وتسمو في ذلك على العقود العرفية التي انتشرت على فترات بين المتعاقدين والمحررات الالكترونية الحديثة العقد بالتقنين وخاصة في الجزائر. الكلمات المفتاحية: عقود رضائية، العقود الرسمية، ضابط عمومي، الطعن بالتزوير، عقود عرفية، محررات الكترونية. Summary: Basically, the contracts are consensual while the official contracts are the exception approved by the legislator in the contracts with economic and social advantages, which he called them official contracts, which are concluded before a public officer or a public official according to written procedures that most regimes and legislations have adopted it, and their authority can only be refuted by appeal for falsification. Jurists have diverged in its division into direct official contract, which considered as basic element of the establishment of the contract and having a definitive authority, and indirect official contract, which is considered as a cornerstone of the proof and transcends the customary contracts which spread, at intervals, between the contractors, as well as modern electronic documents towards the legislation and in particular in Algeria.
