dc.description.abstractتـ التطرؽ الى الرقابػة الخارجية عمى الصفقات العموميػة التي تمػػارسيا لجػػاف الصفقات العمومية المذكورة في القانوف 12-23 والمػػدرجػػة في المرسوـ 247-15 ، مع استحداث المشػرع الجزائري في القانوف 12-23 مجمس وطني لمصفقات العمومية ،و التي غايتيا التأكد مف صحة و مطابقة اجػػراءات الصفقات العمومية لمتشريع و التنظيـ المعموؿ بيما ، ودورىا في حماية الماؿ العاـ وقدتـ إعتماد المنيج الوصفي التحميمي إذ تـ التطرؽ لياتو المجاف مف حيث التشكيمة واالختصاص، إضافة الى اآلثار المترتبة عف عمؿ ىاتػػو المجاف ، والذي تمايز بيف مقرر منػػح التأشيرة او رفض منحيا، وما يترتب عنو مف تنفيذ الصفقة العموميػػػة او عدمو، غير انو اصطدـ بعقبة واجيتو متمثمة في الحػػػؽ الممنوح لممصالح المتعاقدة سواء تعمؽ االمر بحؽ العدوؿ عف الصفقة ، او تجاوز قرار رفض منح التأشيرة ,وعميو توصمنا إلى ضرورة اإلسراع في إصدار النصوص التنظيمية المستمدة مف القانوف 12-23 لضبط عمؿ لجاف الصفقات العمومية ,وتحقيؽ فعالية دورىا الرقابي تماشيا مع التنمية اإلقتصادية المنشودة. الكممات المفتاحية :الصفقات العمومية , لجاف الصفقات العمومية , الرقابة الخارجية , قانوف .12-23 Abstract: External oversight of public procurement, as exercised by the Public Procurement Committees mentioned in Law 23-12 and detailed in Decree 15- 247, was addressed. The Algerian legislator, through Law 23-12, established a National Public Procurement Council aimed at ensuring the validity and compliance of public procurement procedures with the applicable legislation and regulations, as well as protecting public funds. The descriptive-analytical method was adopted to examine these committees in terms of their composition and jurisdiction, in addition to the consequences of their actions, which vary between decisions to grant or refuse approval, affecting whether a public contract is executed or not. However, a significant obstacle was encountered in the form of the rights granted to contracting authorities, including the right to withdraw from the contract or override the decision to refuse approval. Therefore, we concluded that there is an urgent need to issue regulatory texts derived from Law 23-12 to regulate the work of the Public Procurement Committees and to ensure the effectiveness of their oversight role in line with the desired economic development.
