| dc.description.abstract | هدفت دراستنا الموسومة بــ: " الدیمقراطیة التشاركیة في ظل قانون البلدیة الجزائري 1963-2020 " للبحث في آليات وأسس الديمقراطية التشاركية كبعد تنظيري وكإطار للممارسة على المستوى المحلي، وذلك من خلال تقصي منظومته التشريعية والتنظيمية، وبغية الإجابة علي إشكالية الدراسة : ما هو واقع الديمقراطية التشاركية في ظل قانون البلدیة الجزائري 1963-2020 ؟، تم الاعتماد علي منهج دراسة الحالة والمقاربة القانونية وغيرها من المقاربات بغية تقصي تطور المنظومة التشريعية والتنظيمية للوحدة المحلية المدروسة، وتحليل وتفسير منظومتها التشريعية والتنظيمية. ومن أهم نتائج الدراسة تبنىت المؤسسة الدستورية الجزائرية الديمقراطية التشاركية في التعديل الدستوري 2016، وقبل ذلك في قانون البلدية رقم 11-10 ، حيث نص على عدة آليات لمشاركة المواطن في تسيير شؤونه المحلية أهمها الاستشارة المحلية، حق المواطن في الاعلام من خلال حضور المداولات والاطلاع على القرارات البلدية، وكذا من خلال منظمات المجتمع المدني، وخلال تطبيق هذه الآليات ظهرت عدة عقبات تحول دون فعاليتها. الكلمات المفتاحية: الديمقراطية؛ الديمقراطية التشاركية، قانون البلدية الجزائري1963 -2020 ؛ المجالس البلدية المنتخبة ؛ المجتمع المدني؛ حقوق المواطنة . Abstract: Our study, “Participatory Democracy in the Light of the Algerian Municipal Law 1963-2020,” aimed to research the mechanisms and foundations of participatory democracy as a theoretical dimension and as a framework for practice at the local level, by investigating its legislative and organizational system, and in order to answer the problem of the study: What is the reality of Participatory democracy under the Algerian Municipal Law 1963-2020?. The case study method, the legal approach and other approaches were relied upon in order to investigate the development of this local unit, and to analyze and interpret its legislative and organizational system. Among the most important results of the study, the Algerian constitutional institution adopted participatory democracy in the 2016 constitutional amendment, and before that in Municipal Law No. 11-10, where it stipulated several mechanisms for citizen participation in the conduct of his local affairs, the most important of which is local consultation, the citizen’s right to information by attending the deliberations and seeing the Municipal decisions, as well as through civil society organizations, and during the application of these mechanisms, several obstacles appeared that prevented their effectiveness.
