| dc.description.abstract | خالصة القول أن أحكام القانون 12-23 ،المحدد للقواعد العامة الصفقات العمومية جعلت طلب العروض قاعدة عامة إلبرام الصفقات العمومية هذا األخير يلزم المصلحة المتعاقدة باختيار المتعامل المتعاقد الذي يقدم أحسن عرض من حيث المزايا االقتصادية ، مع احترام المبادئ التي نصت عليها المادة 05 منه ،اذ فسح المجال للمصلحة المتعاقدة باختيار النمط المناسب لها حسب ظروف كل عملية تعاقدية وذلك بالنص على أشكال طلب العروض وهي طلب العروض المفتوح ،طلب العروض المفتوح مع اشتراط قدرات دنيا ،طلب العروض المحدود ،المسابقة ،وهذا بإتباع إجراءات معينة أثناء اإلبرام . كما أعتمد التفاوض بشكليه التفاوض المباشر، والتفاوض بعد االستشارة كإستثناء إلبرام الصفقات العمومية ،وهي حاالت مذكورة على سبيل الحصر في المواد 41و42 من القانون السالف الذكر . الكلمات المفتاحية: الصفقات العمومية، طرق االب ارم، طلب العروض، التفاوض Summary of the note To sump up ; the provision of law 23/12 regualating public transaction have made the core of tenders a general rule for conclding public tranactions. The letter obliges the contractor interest to choose the contractor that makes the best offer in terms of economic advantages.It has allowed the contracting interes t to choose the appropriate pattern for it according the circumstances of each contractual process by providing for the forms of request for proposals ;nomely request for proposals with the requirement of minimum capabilities ;limited request for proposals and comprtition for all by following certain procedures during the concludion of the request for proposals be its precedent and subsequent. The nagotiation was also adopted in the form of direct negotiation and negotiation after consultation as an exception to the conclusion of public transaction ;which are cases mentioned exclusively in articles 14/12 of the aforementioned law :following previous and subsequent procedures during the conclusion in this manner .This is with respect for the principles contained in articles 5 of key words : public transactions ،méthodes of conclusion ،requeté for offerts، négociation | |
