Abstract
تعتبر جرائم الحرب من الجرائم الدولية التي تعتبر خرقا لأحكام القانون الدولي الانساني، و قد أخذت حيزا واسعا في الفقه و القانون الدوليين كتتويج لجهود المجتمع الانساني، وصولا الى النطاق المؤسسي و عبر مختلف المواثيق الدولية سعيا لإعطاء تعريف قانوني واضح لها انطلاقا من تجريم المجتمع الدولي لها، و الاقتناع بضرورة التصدي لمثل هذه الجرائم بمعاقبة مرتكبيها بدءا من تحديد المسؤولية عن الافعال التي تشكل جرائم حرب في منظور القانون الدولي الانساني.
أضفى اجتهاد المجتمع الدولي وسعيه للتصدي لجرائم الحرب الى عقد اتفاقيات ومعاهدات من اجل خلق آليات ذات قوة دولية قضائية و غير قضائية لمتابعة ومعاقبة مرتكبي الافعال التي تشكل جرائم حرب في منظور القانون الدولي انطلاقا من تحديد المسؤولية الدولية عن الأفعال و السلوكات التي تشكل انتهاكا للقانون الدولي الانساني.

Abstract
War crimes are considered among the international crimes that are considered a violation of the provisions of international humanitarian law, and have taken a wide space in international jurisprudence and law as a culmination of the efforts of the human community, up to the institutional level and through various international conventions in an effort to give a clear legal definition of them based on the international community's criminalization of them And the conviction of the necessity to address such crimes by punishing the perpetrators, starting with the determination of responsibility for acts that constitute war crimes in the perspective of international humanitarian law.
The endeavor of the international community and its endeavor to address war crimes has been added to the conclusion of agreements and treaties in order to create mechanisms with international judicial and non-judicial power to follow up and punish the perpetrators of acts that constitute war crimes in the perspective of international law, based on the determination of international responsibility for acts and behaviors that violate international humanitarian law.
