| dc.description.abstract | بين نشاط إداري يهدف إلى حماية النظام العام بتقييد ممارسة الأفراد لنشاطاتهم وهو ما يعبر عنه و ظهور بالضبط الإداري و حريات عامة لهؤلاء زاد واقع الحال من أهميتها في ظل زيادة الوعي القانوني مؤسسات لحماية وتعزيز تلك الحريات ، بين هذين التناقضين الذين تفرض أهمية كل منهما توسيع مجاله كان لزاما إيجاد حد لأحدهما بغرض حماية الأخر ولما كانت الإدارة صاحبة امتياز و مركز أسمي وجب وضع حدود العادية و وضع رقابة قضائية فعالة و لسلطاتها تتمثل في احترام مبدأ المشروعية أو سيادة القانون في الظروف متخصصة على القرارات الضبطية في الظروف الاستثنائية التي تهدد استقرار و استمرارية الدولة. الكلمات الدالة : الضبط الإداري ، الحريات العامة ، مبدأ المشروعية ، الظروف الاستثنائية Abstract: Between an activity administration witch protect the public order restricting the practice of individuals to their activities which is expres pressed the administration police and public freedoms for these , increasing the reality of their importance in the light of the growing legal awareness and the emergence of institutions to promote and protect these freedoms beteen the two contradiction who imposed the importance of each to expand its scope had to find an end to one of them in order to protect the other and when the administration have franchise center loftiest must set limits on the power and of respect for the principle of legality or the rule of law in normal circumstances and put judicial oversight effective and specialized decisions seizure in exceptional circumstances that threaten the stability and continuity and continuity of the state Key words : the administration police, the public freedoms, the principle of legality , exceptional circumstances | en_US |
