| dc.description.abstract | إن حق الطفل أو الحدث في الحماية حق تفرضه الفطرة، وتحفظه الغريزة، وتحميه التعاليم السماوية، وتحث عليه المواثيق والاتفاقيات الدولية، وتنظمه القوانين. وإذا تأملنا واقعنا المعاصر على مستوى الجزائر أو على مستوى باقي الشعوب الأخرى نجد ثمة العديد من الأطفال صاروا عرضة لجرائم عديدة، تشكل تهديدا صارخا لهم سواء في حياتهم وسلامة أجسامهم أو في نفسيتهم وأخلاقهم. هذا بالنسبة للطفل كضحية، ومن جهة أخرى فإن الأرقام الإحصائية لجرائم الطفولة الجانحة أو التي هي في حالة الخطر المعنوي في السنوات الأخيرة توحي وبشكل ملفت للنظر أننا أمام تنامي ظاهرة جنوح الأحداث. وهو ما دفعنا إلى البحث عن مدى نجاعة السياسة الجنائية التي انتهجها المشرع الجزائري في توفير الحماية الجنائية للطفل المجني عليه من جهة، وتحقيق فكرة الردع والإصلاح للطفل الجانح من جهة أخرى. الكلمات المفتاحية:. طفل ، حدث، جنوح، إجرام ، السياسة الجنائية للأحداث Résumé : The right of a child or a juvenile to protection is a right imposed by nature, protected by instinct, protected by divine teachings, urged by international instruments and conventions, and regulated by law. Reflecting on our contemporary reality at the level of Algeria or other peoples, many children are vulnerable to numerous crimes, which pose a flagrant threat to them, whether in their lives or in the safety of their bodies or in their psyche and morals. In the case of a child as a victim, on the other hand, the statistical figures for the crimes of children in conflict with the law or in a situation of moral danger in recent years suggest that we are faced with the growing phenomenon of juvenile delinquency. This has led us to explore the effectiveness of the Algerian legislature's criminal policy in providing criminal protection to the child victim, on the one hand, and the idea of deterrence and reform for the child offender, on the other.
