| dc.description.abstract | خمصت ىذه الدراسة الى شرح حاالت الدفع بالنظام في التشريع الجزائري، وكيف تعامل المشرع مع حاالت الدفع بالنظام من خالل اآلثار المترتبة عميو، وشروط التمسك بو وأىم تطبيقاتو. كما تعتبر مسألة تطبيق القانون االجنبي امام القاضي الوطني من المسائل الميمة دوليا وذلك لتشابك العالقات بين االفراد مما يثير في غالب االحيان عدة نزاعات لذلك اوجد المشرع الية لتنظيم تمك العالقات وتتمثل في قواعد االسناد، التي ترشد القاضي الى القانون االنسب لحكم النزاع ، من اجل حماية حقوق االجانب. الكممات المفتاحية: الدفع بالنظام، االستبعاد االجنبي، القاضي الوطني، الغش. Abstract: This study concluded by explaining the cases of payment of the system in the Algerian legislation, and how the legislator dealt with cases of payment of the system through its implications, the conditions for adhering to it and its most important applications. The issue of applying foreign law before the national judge is also considered one of the important issues internationally, due to the intertwining of relations between individuals, which often raises several disputes. Therefore, the legislator created a mechanism to regulate these relations, which is represented in the rules of attribution, which guide the judge to the most appropriate law to rule the dispute, in order to protect the rights of foreigners..
