| dc.description.abstract | نخلص الى ان عقد الكفالة يعد من بين أهم التأمينات الشخصية التي كانت تستعمل منذ العصور البدائية ألى غاية يومنا هذا لكن وفق تحديثات جديدة سواءكان عقد شرعي مفاده كفالة طفل قاصر حيث نجد أن الإسلام أرسى أهم الأسس التي تنظم العلاقة مابين الكافل والمكفول في آيات القرآن الكريم، أما المشرع الجزائري فقد وضع لها مجموعة من الأحكام تحت عنوان قانون الأسرة الجزائري من المادة 116إلى المادة 125. بالإظافة إلى تنظيم علاقة المديونية التي تقوم بين الدائن والكفيل في حال تخلف المدين الأصلى عن الوفاء بالدين عند حلول أجل الاستحقاق حيث نجد أن المشرع الجزائري كباقي التشريعات الأخرى نظم أحكامها تحت عنوان القانون المدني الجزائري من المادة644إلى المادة 673.
