Abstract
To achieve lofty goals, the Algerian legislator has established in the Family Code a system of guardianship and trusteeship over the assets and lives of minors. This system aims to care for, protect, and preserve them through education and guidance, on the one hand, and to safeguard their assets through preservation, development, and stability, on the other hand. This serves to benefit them in particular and society in general.
Guardianship and trusteeship are two legal systems essential to providing exceptional protection and care for minors, both in managing their financial transactions and even their personal lives due to loss or diminished capacity. This, of course, is in accordance with the law. The primary purpose of imposing this guardianship or trusteeship is to protect the minor, who is presumed to be weak and resourceful, by replacing him with a guardian or trustee presumed to be intelligent, trustworthy, mature, and prudent.
