| dc.description.abstract | استقرت قرارات المحكمة العليا على تثبيت الزواج العرفي، واعتباره صحيحا بمجرد استفائه لشروطه الشرعية وقد نظم من القانون الحالة المدنية وقانون الإجراءات الإدارية والمدنية وإجراءات اثبات وتسجيل العقود الزوجية والعرفية . إلا أن المشرع الجزائري لم يسن عقوبات ردعية للحد من ظاهرة الزواج العرفي مما جعل هذا النوع من العقود مستمر غي المجتمع الجزائري . أما فيما يخص الطلاق العرفي الناجم الخارج عن أي واقع خارج مجالس القضاء فإن قانون الأسرة الجزائري لا يعترف إلا بالطلاق الذي يصدر بشأن حكم قضائي، إلا أن ذلك لا يمنع من الاعتداد به وفق للأحكام الشريعة الإسلامية بشرط إثباته وفق طرق الإثبات المقررة قانونا . الكلمات المفتاحية: الإثبات، العقد، الزواج، الطلاق العرفي Summary : The decisions of the Supreme Court have established the customary marriage, and it is considered valid once it fulfills its legal conditions. The law regulates the civil status, the Administrative and Civil Procedures Law, and the procedures for proving and registering marital and customary contracts. However, the Algerian legislator did not enact deterrent penalties to limit the phenomenon of customary marriage, which made this type of contract continuous in the Algerian society. As for the customary divorce resulting from any reality outside the judicial councils, the Algerian family law only recognizes divorce that is issued in connection with a judicial ruling, but this does not prevent it from being considered in accordance with the provisions of Islamic Sharia, provided that it is proven according to the legally established methods of proof.
