| dc.description.abstract | تناولنا في هذه الرسالة موضوع الرقابة والإشراف على العملية الانتخابية في الجزائر حيث تطرقنا لأشكال الرقابة التي أقرها المشرع الجزائري قي كل مراحل العملية الانتخابية بداية من المرحلة التمهيدية وما تضمنته من قيد في قوائم الانتخابية وضوابط بطاقة الناخب ثم عملية الترشح وكيفية سيرها وشروطها وصولا إلى الحملة الانتخابية وضبط صيرورتها وعملية تمويلها، ثم تناولنا العملية الانتخابية أثناء وبعد الاقتراع من تصويت وفرز للأصوات ثم إعلان النتائج ، كما أن لم مشرع خصص للقضاء دورا كبير في مختلف مراحل العملية الانتخابية من حل لنزاعات وتسليط العقوبات الرادعة للأفعال التي قد تمس بنزاهتها في الفصل الأول، أما فيما يخص الفصل الثاني فقد خصصناه لدراسة المؤسسات الدستورية التي كرسها المشرع في التعديل الدستوري 2020 ومنحها صلاحيات واسعة إبتداءا من المحكمة الدستوري التي خلفت المجلس الدستوري بسبب فشله الذريع وصولا إلى دسترة السلطة الوطنية المستقلة للانتخابات نتيجة لمطالب شعبية وسياسية. وكإستنتاج عام في رأينا أن المشرع الجزائري قد وفق في هذه التدابير حيث نجح في منح الثقة والطمأنينة في نفوس الشعب الجزائري خاصة أنه في الفترات السابقة تم فقد ثقة في الانتخابات بسبب تدخل وتحكم السلطة التنفيذية فيها ،فحاول المشرع منحها الاستقلالية حتى ولو كانت نسبية من خلال وضع حدود لكل التجاوزات التي تمنع إنتخابات نزيهة . الكلمات المفتاحية: الرقابة، الإشراف، العملية الانتخابية Abstract: In this study, we addressed the subject of supervision and supervision of the electoral process in Algeria. We discussed the forms of control approved by Algerian legislature in all stages of the electoral process, beginning with the preliminary phase, the registration of electoral lists, the checks of the voter's card, the process of election, how it proceeds and conditions to the electoral campaign, its determination and financing process. and then we took up the electoral process during and after the ballot from the vote and counting and then the results were announced, Nor has any legislator dedicated to the judiciary played a significant role in the various stages of the electoral process in resolving conflicts and shedding deterrent sanctions against acts that may affect their integrity in Chapter I. With regard to chapter II, we have devoted it to the study of the constitutional institutions enshrined by the legislature in the constitutional amendment 2020 granting it broad powers from the Constitutional Court, which succeeded the Constitutional Council because of its abject failure to achieve the constitutionality of the Independent National Electoral Authority as a result of popular and political demands. As a general conclusion, in our view, the Algerian legislature has complied with these measures by succeeding in giving confidence and reassurance to the Algerian people, especially since in previous periods there was a loss of confidence in the elections because of the interference and control of the executive branch, the legislature has attempted to give them independence, even if relative, by setting limits on all abuses that prevent fair elections.
