Abstract
يخضع التاجر لنظام قانوني يختلف عن ذلك الذي يخضع له غير التجار، لذلك فالمشرع الجزائري إهتم بتنظيم هذه الفئة من الأشخاص وفق تنظيم قانوني خاص يتفق مع مقتضيات التجارة ومتطلباتها.
وقد حدد المشرع الجزائري الأشخاص المؤهلون لإكتساب هذه الصفة، وكذا الشروط التي يخضع لها لإكتساب الصفة التجارية، كممارسة الأعمال التجارية بإحتراف وتوافر الأهلية التجارية للشخص الذي يرغب في ممارسة التجارة، ويترتب على إكتساب هذه الصفة أثار وإلتزامات مهنية، كمسك الدفاتر التجارية والقيد في السجل التجاري، كما قد خصص جزاءات مدنية وجزائية مترتبة على عدم مسك الدفاتر التجارية والقيد في السجل التجاري.
وهذا من أجل تنظيم وتطهير النشاطات التجارية والقضاء على المنافسة غير المشروعة.
Résumé:
The trader is subject to a legal system different from that of non-traders, so the Algerian legislator is interested in regulating this category of persons in accordance with a special legal regulation consistent with the requirements of trade.
The Algerian legislator has identified persons eligible for this status, as well as the conditions to which he or she is subject to commercialization, such as professional business practice and the availability of commercial eligibility of a person wishing to trade, and the acquisition of this status entails professional implications and obligations, such as commercial bookkeeping and registration in the commercial register, as well as civil and penal sanctions resulting from the failure to keep commercial books and registration in the commercial register.
This is in order to regulate and cleanse business activities and eliminate illegal competition.
