| dc.description.abstract | من خلال هذه الدراسة نطرح إشكالا أساسي يتمثل في: كيف عالج المشرع الجزائري جرائم الاهمال العائلي وما مدى تأثيره على جنوح الأحداث التي تعد مشكلة كبيرة نظرا لانعكاساتها المختلفة, حيث تدخل جملة عوامل نفسيه وأسريه واجتماعية في دفع الأحداث إلى الإجرام, الاهمال العائلي, وعليه يخضع الحدث الجانح لإجراءات استثنائية في جميع مراحل المتابعة القضائية. حيث أن الحماية المقررة للطفل في الحالات التي يتعرض فيها الى تصدع البناء الأسري بتخلي أحد الوالدين أو كلاهما بشكل كلي أو جزئي عن المهام والالتزامات المنوطة بهم قانونا. الأمر الذي يجعل الطفل عرضة للإهمال العائلي, الذي يشكل جريمة يعاقب عليها جنائيا في قانون العقوبات الجزائري بموجب القانون رقم 06-23 المؤرخ في 20/12/2006 وكل القوانين التي تلته تعدله وتممه, وكذا بموجب القانون المتعلق بحماية الطفل الصادر بالقانون رقم 12-15 المؤرخ في 15 يوليو 2015 Abstract : Throughout this study, we discuss a fundamental problem: How did the Algerian legislator treat the crimes of family neglect and what is its impact on juvenile delinquency. We also talk about its various repercussions as a number of psychological, family and social factors enter into pushing juveniles to crime, family neglect. Therefore, the juvenile delinquent is subject to exceptional measures at all stages of judicial follow-up. This study focuses on the issue of the criminally mandated protection of the child in cases where he is exposed to a rupture in the family structure. This can result from abandoning one of the parents or both of them to their tasks and obligations entrusted to them by law, Which makes the child vulnerable to family neglect. This issue is recognized as criminally punishable in the Algerian Penal Code under Law No. 06-23 of 20/12/2006 and all subsequent laws amending and completing it, as well as under the Law on Child Protection promulgated by Law No. 12-15 Dated 15 July 2015. | en_US |
