| dc.description.abstract | يمكن القول إنه وبالرغم من تخصيص المشرع فصل خاص لقسم شؤون األسرة ضمن قانون اإلجراءات المدنية واإلدارية تضمن المواد من 423 إلى 499 إلى أن العديد من المسائل لم يتطرق اليها المشرع بالبيان والتحديد كما أن هناك تعارض بين الكثير من األحكام اإلجرائية والموضوعية المتعلقة بقضايا األسرة كل ذلك يدعو لدراسة اإلشكالية التالية: ما مدى خصوصية المنازعة األسرية في ظل قانون اإلج ارءات المدنية واإلدارية؟ وفق خطة تتكون من مقدمة وفصلين وخاتمة، تناول الفصل االول الضوابط االجرائية واألحكام العامة وتناول الفصل الثاني الضوابط اإلجرائية واألحكام الخاصة، وتم االعتماد على المنهج التحليلي وذلك من خالل تحليل النصوص القانونية المتعلقة بموضوع الدراسة كما تم التعرض للتطبيقات القضائية من خالل قرارات المحكمة العليا من أجل إحاطة أكبر بالموضوع، وكنتيجة تظهر ضرورة تخصص إجرائي للمنازعة األسرية بما يكفل خصوصيتها. الكلمات المفتاحية: ضوابط، إجرائية، خصوصية، منازعة، أسرية Abstract: Although the legislator dedicated a special chapter to the Family Affairs Department within the Civil and Administrative Procedure Law, including articles from 423 to 499, many issues remain unaddressed with specificity. There is also a conflict between many procedural and substantive provisions related to family issues. This study explores the specificity of family disputes under the Civil and Administrative Procedure Law through an introduction, two chapters, and a conclusion. The first chapter covers procedural controls and general provisions, while the second addresses specific procedural controls and provisions. An analytical approach is used, analyzing legal texts and presenting judicial applications from Supreme Court decisions to provide a comprehensive understanding.
