Abstract
إن لتطبيق مبدأ المنافسة على الصفقات العمومية بمختلف أنواعها في المرحلة التحضيرية ومرحلة الإبرام، أثر إيجابي ينعكس على ضمان نجاعة الطلبات العمومية، والاستعمال الحسن للمال العام، وبهدف حماية هذا المبدأ أَطَر المشرع الفرعي (المنظم) الجزائري بالإضافة للضمانات التي تضبط المرحلة السابقة عن التعاقد ومرحلة الإبرام خاصة المبادئ التي تساهم في تكريس المنافسة، آليات رقابية أصيلة في تنظيم الصفقات العمومية تمارس مختلف أنواع الرقابة في شكل رقابة داخلية و/ أو رقابة خارجية، ضمن حدوٍد واطر رسمها المرسوم الرئاسي رقم 247-15دون المساس بالأحكام القانونية الأخرى والتي تطبق على هذه الآليات الرقابية

Abstract:
The application of the principle of competition to all types of public transactions at the preparatory and conclusion stages has a positive effect on ensuring the efficiency of public applications and the good use of public money, and with a view to protecting the sub-legislator's frameworks In addition to thesafeguards that regulate the pre-contract phase and the conclusion phase, in particular the principles that contribute to the establishment of competition, Algerian regulatory mechanisms that regulate public transactions and exercise various types of oversight in the form of internal and/or external control, within the limits and frameworks established by Presidential Decree No. 15-247, without prejudice to other legal provisions applicable to such monitoring mechanisms
