| dc.description.abstract | تختص المحكمة التجارية المتخصصة بالفصل في المنازعات التي حددتها المادة 635 مكرر من القانون رقم 33-22 ، أما االختصاص اإلقليمي فيقتضي الرجوع إلى أحكام قانون اإلجراءات المدنية واإلدارية، كما و أن المرسوم التنفيذي رقم 63-23 حدد عدد هذه أر بع مساعدين يكون لهم رأي تداولي، قاضٍ و : 32 محكمة، و تتشكل المحكمة من المحاكم بـ حيث حدد المرسوم التنفيذي رقم 62-23 شروط و كيفيات اختيارهم ، ويمكن أن تقسم المحكمة إلى أقسام حسب طبيعة وحجم النشاط القضائي ، وتم فرض إجراء الصلح كقيد لرفع الدعوى أمامها، فإن فشل الصلح أمكن رفع الدعوى بالطرق المعتادة مرفقة بمحضر عدم الصلح -تحت طائلة عدم قبول الدعوى شكال– تنتهي الخصومة بحكم قابل لالستئناف أمام المجلس القضائي. Abstract : The Specialized Commercial Court is competent to adjudicate disputes specified in Article 536BIS of Law No22-13 , while territorial jurisdiction requires reference to the provisions of the code of civil and Administrative Procedure, Executive Decree No 23-53 , which limited the number of such courts to 12 . The court consists of a judge and four assistants who have a deliberative opinion, where Executive Decree No 23-52 specified the conditions and how to choose them. The conciliation procedure was imposed as a restriction on filing a claim before her, if the conciliation failed, the claim could be filed in the usual ways, attached to minutes of non-conciliation, under penalty of inadmissibility of the claim in the form. The dispute ends with a verdict that can be appealed to the Judicial Council. | en_US |
