| dc.description.abstract | مرحلة تنفيذ أحكام المحكمة الجنائية الدولية تعد المرحلة التي يتم فيها تحويل الحكم المكتوب إلى واقع ملموس ولتنفيذ هذا الحكم يجب أن تتوفر جميع الشروط الشكلية والموضو عية ليكون صالحا وقابال للتنفيذ، ويحدد النظام األساسي للمحكمة اإلجراءات المحددة لتنفيذ كل نوع من العقوبات المنصوص عليها في المادة 77 منه وتلتزم الدول األعضاء بالتعاون في تنفيذ هذه األحكام، ويمكن للمحكمة أن تستعين بعالقتها باألمم المتحدة واإلنتربول، وحتى بالدول األخرى، لضمان تنفيذ هذه األحكام بشكل فعال،الن هاته االخيرة ال تمتلك مؤسسات عقابية خاصة بها لتنفيذ هذه العقوبات مما يطرح عدة اشكاليات مادية واخرى سياسية وجب التصدي لها من خالل ادراج بعض التعديالت على النظام االساسي. Abstract The stage of implementing the judgments of the International Criminal Court (ICC) is the phase, which the written judgment is transformed into tangible reality. To execute these judgments, all formal and substantive requirements must be available to be valid and enforceable. The ICC Statute specifies specific procedures for implementing each type of punishment provided in Article 77, and member states are obligated to cooperate in implementing these judgments. The Court can seek assistance from its relationship with the United Nations, Interpol, and even other states to ensure the effective enforcement of these judgments, as the Court itself does not possess its own penal institutions for executing these punishments. This raises several practical and political challenges that need to be addressed through incorporating amendments to the Statute. | en_US |
